Terms of Use - Global Star Auto Traders

1. General

These Terms and Conditions (“Agreement”) govern the use of the services (“Service”) made available by Global Star Auto Traders Ltd, www.gsat.com (“Company”, “GSAT”, “we” or “us”).

These Terms and Conditions represent the whole agreement and understanding between GSAT, the individual or entity who subscribes to our service (“Subscriber”, “you” or “Buyer”), and any purchased item referred to as “Stock”, “Goods”, “Vehicles” or “Parts”.

PLEASE READ THIS AGREEMENT CAREFULLY. By using our Service, you agree to comply with all terms and conditions set out in this Agreement.

GSAT may terminate your account at any time, with or without notice, for conduct that is in breach of this Agreement, conduct that GSAT believes is harmful or fraudulent to its business, or conduct where the use of the Service is harmful to any other party.

GSAT may, at its sole discretion, change or modify this Agreement at any time, with or without notice. Updates made on the GSAT website as Terms of Use are your responsibility to review from time to time to ensure that your use of the Service remains in compliance with this Agreement.

2. Services

GSAT offers the following services:

In-house stocks: Choose from the ready stock list.
Auctions: Choose from the auction stock list.
Special request services: Choose from the domestic stock list.

Customers may use any of the services offered by GSAT based on their needs and availability of stock.

3. Order and Cancellation

Orders

Orders are accepted through website inquiry only. It is the buyer’s responsibility to check and confirm any specific requirements before purchase, including type, year of manufacture, fuel, transmission, seats and other details.
GSAT reserves all rights to cancel or stop any fraudulent or incomplete order without prior written or verbal notice.
GSAT used vehicles make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability of website information, goods, products, services or related graphics contained on gsat.com for any purpose. Any reliance you place on such information is strictly at your own risk.
In-house stock list vehicles are available on a first come, first served basis only. If payment reaches GSAT late and the vehicle is sold to another customer, GSAT will supply a vehicle with matching specifications where possible.
GSAT is not responsible for any damage that occurs to the vehicle during and/or after it has reached the destination port.
GSAT is not liable for disputes between the buyer and third parties that may arise through the use of our services.

Cancellation Before Reserving Vessel / Boarding

Buyer may cancel the order before the goods are shipped and will be liable to pay a cancellation fee depending on the total invoice amount.

More than 5,000 USD	20% of total price and port charges, if any incurred

In certain circumstances, including specific vehicles, vehicles older than 15 years, trucks, buses, construction equipment and similar cases, GSAT reserves the right to collect a cancellation fee of up to 100% of the total price if the company is making losses due to the cancellation.

Cancellation After Boarding

If the buyer cancels the order after the goods have been shipped, the buyer will be required to pay a cancellation fee as detailed below.

Cancellation Due to Delayed Payment

If GSAT decides to cancel the order due to delay in payments and payment is not received even after the grace period provided by GSAT, cancellation charges apply as below.

4. Payments

For payment options, please contact GSAT or refer to the payment information provided by the company.

Auction Service

A deposit of 1,000 USD must be made prior to activating the auction account. First payment must be made within two weeks of purchasing the stock from auction.

In-house Stock / Domestic Stock

First payment must be made within 3–4 business days from the date the proforma invoice is issued.

Balance payment must be made before the vehicle arrives at the destination port for the release of documents. Any delay in payment may delay document release. GSAT is not responsible for port charges caused by delayed payments.

If the customer does not pay the balance even after reminders, the order will be considered cancelled and no payments will be refunded in order to recover losses incurred.

To prevent fraud, all payments must be made by wire transfer to our bank only. When filling a bank receipt for wire transfer, the buyer must write the company name and email or fax/send a copy of the bank receipt. Buyers must cross-check bank details before making payments.

GSAT may also accept irrevocable L/C at sight, but not for all countries.

5. Stocks Advertised / Shipped

Please be advised that GSAT only sells used cars unless the vehicle is advertised as brand new. Used cars may have marginal defects, and the customer should understand that claims will not be paid due to the vehicle not being in brand new condition.
Vehicle export certificate documents (“Masho”) show the year according to Japanese policy and not necessarily the manufacturing date. Seat belt year is not considered as the manufacturing year.
